Introduction

Dedicated to providing tailored solutions that meet and exceed clients’ expectations

The Guernsey property department is dedicated to providing tailored solutions that meet and exceed clients’ expectations. In addition, the property department provides support to colleagues in the corporate and dispute resolution departments on real estate-related technical points of law.

The team’s areas of property expertise encompass sales, purchases, leases, licences, boundary issues, property development documentation, legal title and banking paperwork.

Our planning experience means that we are often called upon to provide strategic advice, submit planning applications, deal with enforcement issues and conduct planning appeals.

In environmental law matters, we regularly provide legal opinions and assist clients with minimising and managing risk.

For private client considerations, we assist with wills of realty and personalty, codicils and Guardianship applications, whilst for housing/population queries we regularly advise on questions relating to the new population regime.

The team has a deep understanding of the real estate marketplace and is alive to the importance of offering value for money. In most instances, a fixed fee pricing model is offered. With more complex or time-consuming matters, alternative fee models can be arranged.

We also have expertise in dealing with the most complex and difficult probate issues sensitively, quickly and efficiently. In addition to assisting local families, we also work with individuals, law firms and institutions from overseas who need to obtain grants of probate in Guernsey in order to release assets held here.

Expertise

Residential Conveyancing

With our extensive Bailiwick knowledge, whether you are buying, selling or renting, we are always here to help you.

Open Market or Local Market, we visit every property that our purchasing clients are involved with, and we liaise closely with all clearing banks to ensure mortgage paperwork is dealt with swiftly and efficiently.

For more complex matters such as schedules, délaissances, exchanges and document duty advice, we are ideally placed to provide solutions.

Our cloud based IT systems mean we can work whenever and wherever work requires.  All our clients have direct dial access to everyone in the firm including Advocates to ensure that our clients feel valued and that their needs are met in a ‘trusted adviser’ relationship.

Planning & Environmental Law

We are often called upon to advise on discrete pieces of planning work, and also environmental law matters.

This includes working closely with the Development and Planning Authority, the Health & Safety Executive, the Law Officers of the Crown and other statutory bodies.  Due to the sophisticated nature of our instructions, we have developed excellent working links with key government decision makers and which our clients have found to be very beneficial.

Population Management

With Human Rights considerations sitting alongside a significant piece of legislation and guidance notes, we are often called upon to help individuals and business to navigate their way through residency and occupation considerations.

This, in turn, means we are able to assist with queries from foreign lawyers on matters such as immigration and relocation requirements.

Again working closely with the Population Management Office, the Guernsey Border Agency and Locate Guernsey, our clients’ needs are fully met and we are always on hand to deal with any queries.
